Terms & Conditions of Sales
Article 1: Duration of stay
The tenant who has entered into a fixed-term contract may not, under any circumstances, claim any right to remain on the premises at the end of the stay.
Article 2: Conclusion of the contract
The reservation becomes effective (confirmed) as soon as the tenant has sent the owner a deposit representing 25% of the total rental amount. An email with the status of your account will be returned to you by the owner upon receipt of the deposit. The rental concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, natural or legal persons, unless the owner agrees in writing. The number of people and possibly animals accommodated is defined at the time of booking and may only be modified upon prior request. Any breach of this last paragraph would be likely to result in the immediate termination of the rental at the tenant's expense, with the rental proceeds remaining definitively acquired by the owner.
Article 3: Cancellation by the tenant
a/ Cancellation before arrival on site
Cancellation between the 60th day and 31st day before the start of the stay: your deposit will be refunded.
Cancellation between the 30th day and the 15th day inclusive before the start of the stay: 30% of the price of the stay will be retained.
Cancellation between the 14th day and the 3rd day inclusive before the start of the stay: 50% of the price of the stay will be retained.
Cancellation between the 2nd day and the day of arrival: 100% of the price of the stay will be retained.
In the event of a no-show by the customer, no refund will be made. If the tenant does not show up within 24 hours of the arrival date indicated on the contract, this contract becomes null and void and the owner can dispose of his lodging. The amount of 100% of the reservation will be debited from the bank card as a guarantee.
b/ Stay shortened by the tenant
The rental price remains the property of the owner. No refund will be made.
Article 4: Cancellation by the owner
If, due to force majeure, the owners are unable to receive the tenants, the payments made will be immediately and fully reimbursed.
Article 5: Arrival
The tenant must arrive on the specified day and between 3 p.m. and 8 p.m.
In the event of late or delayed arrival, the tenant must notify the owner.
Article 6: Payment of the balance
The balance of the rental is to be paid upon your arrival at the rental. The refundable deposit as well as the tourist tax will also be requested.
Article 7: Inventory
An inventory is drawn up by the parties upon arrival and departure from the gîte. At the end of the rental period, each party keeps a signed copy. This inventory constitutes the only reference in the event of a dispute concerning the inventory of fixtures. The cleanliness of the gîte upon the tenant's arrival must be noted in the inventory of fixtures. Cleaning of the premises is the responsibility of the tenant during the rental period (unless they have subscribed to the daily cleaning package) and before their departure. The amount of any costs is established on the basis of the calculation mentioned in the description sheet. Possibility of subscribing to two cleaning packages: daily package or end-of-stay cleaning package.
Article 8: Refundable deposit
A refundable deposit of €30/day is required by the owner. It is to be paid when the keys are handed over at the start of the stay. After the contradictory establishment of the exit inventory, this deposit is returned within a period not exceeding one week, after deduction of the cost of restoring the premises if damage is noted. In the event of the presence of an animal in the rental, the deposit is increased by €10/day.
Article 9: Use of the premises
The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises. He must avoid any noise likely to disturb the neighbors, in particular those emitted by radio, television and other devices. For regulatory reasons and in order to preserve the tranquility of the residents, the owners reserve the right to refuse to welcome guests of the tenants in the premises.
Article 10: Capacity
This contract is established for a maximum capacity of people. If the number of tenants exceeds the capacity of the accommodation, the owner may refuse additional people. Any modification or termination of contract will be considered at the initiative of the customer.
Article 11: Animals
This contract specifies whether or not the client may stay with a pet (small dogs under 10 kg upon prior request). In the event of non-compliance with this clause by the client, the owner may refuse access to the premises to animals. In this case, any modification or termination of the contract will be considered at the client's initiative.
Article 12: Use of the Internet
The Internet access provided must not in any way be used for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required.
Article 13: Insurance
The tenant is responsible for all damages caused by him. He is required to be insured by a holiday insurance contract for these various risks. A copy of the insurance policy may be requested by the owner from the tenant when he moves into the premises. The tenant will not be able to exercise any recourse against the owner in the event of theft or damage to the rented premises.
Article 14: Payment of charges
Charges (water, electricity, gas and heating) are included in the rental price.
Article 15: Termination by operation of law
In the event of a breach by the tenant of any of the contractual obligations, this contract will be terminated automatically. This termination will take effect after a period of 48 hours following a simple formal notice by registered letter or hand-delivered letter remaining unsuccessful.
Article 16: Election of domicile
For the execution of these presents, the owner and the tenant elect domicile at their respective addresses. However, in the event of a dispute, the court of the owner's domicile will have sole jurisdiction. This contract and its consequences are subject to French law.
